UAE VAT penalties changed on 14 April 2026. Under Cabinet Decision No. 129 of 2025, the Federal Tax Authority (FTA) now charges AED 10,000 for late VAT registration, AED 1,000 for a first late return and a flat 14% a year on unpaid VAT. That replaces the old charge of 2% on the due date plus 4% every month.
This guide lists the UAE VAT penalties a Dubai business is most likely to meet, shows how each one is calculated and explains what to do if a penalty notice reaches you. A penalty never cancels the tax itself, so you still owe the VAT on top of any fine.
Last verified: October 2026. The figures for UAE VAT penalties come from the FTA-published text of Cabinet Decision No. 40 of 2017 as amended by Cabinet Decision No. 129 of 2025.

What Changed in UAE VAT Penalties on 14 April 2026
Cabinet Decision No. 129 of 2025 was issued on 9 October 2025 and took effect on 14 April 2026. It amends the penalty tables that have applied to VAT since 2018 and brings VAT in line with the way corporate tax late payments are charged.
The UAE VAT penalties that changed most are these:
- Late payment: a monthly charge at 14% a year replaces the earlier 2% immediate charge and 4% monthly charge.
- Voluntary disclosure: a flat 1% a month replaces the former tiers of 5% to 40%. If the FTA has already announced an audit, the fixed charge falls from 50% to 15%.
- Smaller administrative fines: the penalty for failing to give records in Arabic drops from AED 20,000 to AED 5,000. Failing to update registration details drops from AED 5,000 to AED 1,000, and an incorrect return from AED 1,000 to AED 500.
- Unchanged: late registration, late filing, invoice fines and the AED 5,000 price display fine stay where they were.
If a penalty notice relates to a period before 14 April 2026, ask your tax consultant which schedule applies before you pay or dispute it.
UAE VAT Penalties for Late Registration
You must register for VAT within 30 days of your taxable supplies and imports passing AED 375,000 in 12 months. Voluntary registration is possible from AED 187,500.
Missing the deadline costs a fixed AED 10,000. The fine is the same whether you are a week late or a year late. You must also account for the VAT due on every taxable sale made since the date you should have registered, even if you did not charge your customers VAT at the time.
Late VAT Deregistration
If you stop making taxable supplies, or your turnover falls below the deregistration limit, you must apply to cancel your registration, generally within 20 business days. A late application attracts AED 1,000, then another AED 1,000 each month, with a ceiling of AED 10,000.
UAE VAT Penalties for Late Return Filing
VAT returns are due on the 28th day after the end of each tax period, whether you file monthly or quarterly. A late return costs AED 1,000 the first time and AED 2,000 if it happens again within 24 months.
The fine applies per return rather than per day, and a nil return is still a return. Filing on time also does not settle your payment. Tax owed must be paid by the same date.
Late VAT Payment Penalty: How the 14% Rate Works
Of all UAE VAT penalties, late payment is the one that grows the longer a balance stays open. From 14 April 2026 the FTA charges 14% a year on unpaid VAT, applied for each month or part of a month. The charge starts the day after the due date and repeats on the same date each month until you pay.
Illustration: you owe AED 100,000 and pay in the third month after the due date. The monthly charge is AED 100,000 × 14% ÷ 12, or about AED 1,167. Three months gives roughly AED 3,500. Under the earlier rules, the same debt would have attracted 2% (AED 2,000) on day one and 4% (AED 4,000) each month after that.
When extra tax arises from a voluntary disclosure or an FTA assessment, the payment due date is 20 business days after you submit the disclosure or receive the assessment. No late payment charge runs during that window.
UAE VAT Penalties for Incorrect Returns and Voluntary Disclosure
An incorrect return attracts AED 500. You avoid it if you correct the return before the filing deadline, or if you submit a voluntary disclosure that causes no difference in the tax due.
Errors that change the tax payable are handled in one of two ways under the Executive Regulation of the Tax Procedures Law:
- More than AED 10,000 underpaid: submit a voluntary disclosure within 20 business days of discovering the error.
- AED 10,000 or less: you can usually correct it in your next VAT return. If no return is available, file a voluntary disclosure.
The penalty then depends on timing:
- Before the FTA notifies you of an audit: 1% of the tax difference for each month, counted from the day after the original return was due until you disclose.
- After the FTA notifies you of an audit, or if you never disclose: a fixed 15% of the tax difference plus the same 1% each month.
Illustration: AED 40,000 of VAT was under-declared and you disclose it five months after the return was due, before any audit notice. The penalty is 5% of AED 40,000, or AED 2,000. If the FTA had found the same error first, the penalty would be AED 6,000 fixed plus AED 2,000, which is AED 8,000. Disclosing early saves AED 6,000 in this example, and you pay the VAT either way.
Invoice, Record-Keeping and Other UAE VAT Penalties
Several UAE VAT penalties apply to everyday paperwork rather than to the return itself.
| Violation | Penalty |
| Tax invoice not issued within the legal period (generally 14 days from supply) | AED 2,500 for each detected case |
| Tax credit note not issued in time | AED 2,500 for each detected case |
| Electronic invoice or credit note conditions not met | AED 2,500 for each detected case |
| Prices not displayed including VAT | AED 5,000 |
| Failure to keep required records | AED 10,000; AED 20,000 if repeated within 24 months |
| Records not provided in Arabic when requested | AED 5,000 |
| Changes to registration details not reported | AED 1,000; AED 5,000 if repeated within 24 months |
| Legal representative’s appointment not notified | AED 1,000 |
| Margin scheme use not notified | AED 2,500 |
| Failure to facilitate a tax auditor | AED 20,000 |
| Tax on imported goods not calculated | 50% of the unpaid or undeclared tax |
| Designated Zone goods conditions not met | The higher of AED 50,000 or 50% of the tax on the goods |
Invoice fines add up quickly because they apply to every detected case. Twenty non-compliant invoices can mean AED 50,000 in penalties.
Can You Challenge or Reduce UAE VAT Penalties?
Yes. If you believe a penalty is wrong, you can ask the FTA to reconsider its decision through the EmaraTax portal. The request is usually due within 40 business days of being notified. Confirm the exact deadline on your notification, because missing it can close this route.
If the FTA upholds the penalty, you can object to the Tax Disputes Resolution Committee. The disputed tax generally needs to be settled first. The UAE government’s guidance on resolving tax disputes explains the stages.
Strong requests rely on evidence: a portal outage, a bank error, a documented misreading of the law or an FTA calculation mistake. Explaining that you were unaware of the rule rarely succeeds.
How to Avoid UAE VAT Penalties
Most UAE VAT penalties come from missed dates and weak controls rather than complicated tax questions. These habits prevent the majority of them:
- Check turnover every month. Track taxable supplies and imports over the previous 12 months against AED 375,000 and register within 30 days of crossing it.
- Set an internal filing date. Aim to finish the return five working days before the 28-day deadline, and file nil returns too.
- Pay with the return. Treat filing and payment as one task, because the 14% charge starts the day after the due date.
- Issue valid invoices on time. Use software that blocks an invoice missing the required VAT details, and issue it within 14 days of the supply.
- Review before you file. Check VAT codes, reverse charge entries and credit notes against each box of the return.
- Correct errors early. Disclose significant mistakes within 20 business days of finding them.
- Keep your records in order. Store invoices, import documents and workings by tax period for at least five years.
- Update the FTA when details change. A new address, trade name or activity must be reported.

FAQs
What are the main UAE VAT penalties?
The main VAT fines are AED 10,000 for late registration, AED 1,000 or AED 2,000 for a late return, 14% a year for late payment and AED 2,500 for each tax invoice not issued in time.
What is the penalty for late VAT registration in the UAE?
The fine is AED 10,000. It applies once, regardless of how late you register, and you must also pay the VAT due on taxable sales since the date registration was required.
How much is the penalty for filing a VAT return late?
AED 1,000 for the first late return and AED 2,000 for a repeat within 24 months. The same fines apply to nil returns, and they are separate from any charge for paying the tax late.
How is the late VAT payment penalty calculated now?
From 14 April 2026 it is 14% a year on the unpaid tax, charged for each month or part of a month. For AED 50,000 outstanding, each month adds about AED 583.
Does a voluntary disclosure reduce UAE VAT penalties?
Yes. Disclosing before the FTA notifies you of an audit keeps UAE VAT penalties to a 1% monthly charge on the tax difference. Waiting until after notice adds a fixed 15%.
Do I pay a penalty if I file a nil VAT return late?
Yes. Filing late triggers the AED 1,000 or AED 2,000 fine even when no VAT is due. Nil returns must be filed by the same deadline as any other return.
